JUSTICE SHIVAJI PANDEY ORAL ORDER 10-10-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek anticipatory bail in a case instituted for the offences under Sections 341, 323, 379, 504 and 34 of the Indian Penal Code.
It has been informed by both sides that petitioners have already vacated the shop on 08.09.2018.
The matter has already been settled between both the parties and as such there is no need to proceed further in the matter.
Both parties are directed to withdraw their respective criminal cases which have been filed between them.
Patna High Court Cr.Misc. No.26723 of 2018 (5) dt.10-10-2018 2 /2 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Amar Nath Singh, Utkarsh Kumar @ Utkarsh Kumar Singh and Nitish Kumar @ Himanshu Kumar @ Himnshu Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge-XV - cum - Additional Chief Judicial Magistrate, Patna in connection with Hawai Adda P.S. Case No.28 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
