JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in NRPA-RPF Post Case No. 2 of 2016 instituted for the offence under sections 3 RP(UP) Act.
It is submitted that petitioner has no criminal antecedent. He was not apprehended on the spot. From the written report, it appears that on seeing the police party, three accused persons managed to run away after throwing away the articles from their head.
The police identified them as Chhotu Kumar, Kanhai kumar (petitioner) and Kanhai Kumar (son of Prem Thakur). From the written report, it appears that stolen articles of railway property as mentioned in the seizure list were thrown
Patna High Court Cr.Misc. No.9583 of 2017 (2) dt.07-03-2017 2/2 by the petitioner.
In such circumstances, nothing has been recovered from the possession of this petitioner. There is no signature of petitioner on the seizure list.
It is mentioned in para-3 that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with NRPA-RPF Post Case No. 2/2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway, J.M., Sonepur , Saran, subject to the conditions as laid down under Section 438(2) Cr.P.C (Sanjay Priya, J) Ravi/- U T
