It has been submitted on behalf of the petitioners that petitioner no. 1 along with other petitioners, had earlier moved before this Court in Cr. Misc. No. 7465 of 2017 and vide order dated 20.02.2017, this application was disposed of with a liberty so far petitioner no. 1, Birendra Yadav is concerned that he shall be enlarged on provisional bail for a period of three months and in the meantime, he will execute the sale deed as undertaken by him in favour of the informant and after execution of sale deed, the learned court below shall confirm the provisional bail of the petitioner no. 1. It is further submitted that there is no undertaking

Patna High Court Cr.Misc. No.14491 of 2017 (2) dt.29-03-2017 2/2 submitted by petitioner no. 1.

Considering the above submission, so far prayer for bail of petitioner no. 1 is concerned, his prayer is rejected and so far other petitioners are concerned, the order dated 20.02.2017 passed in Cr. Misc. No. 7465 of 2017 will remain continued. Accordingly, this petition is disposed of with modification to the above extent in the order dated 20.02.2017 passed in Cr. Misc. No. 7465 of 2017.
