Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the IPC. The allegation against the petitioner as per the First Information Report is that 5-6 unknown miscreants came and tied the informant on the trailer of his Eicher Tractor and looted the informant's vehicle loaded with Horlics, 2 Samsung Mobiles and cash of Rs.13,000/-.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in the present case

Patna High Court CR. MISC. No.56357 of 2021(4) dt.13-07-2022 2/2 only on the basis of suspicion. He further submits that in fact the petitioner is a Rickshaw Puller and he has no concern at all with the alleged occurrence.

On the other hand learned counsel for the state on the basis of the material on the record and the case diary submits that there is sufficient material against the petitioner during investigation.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Rajaun P.S. Case No. 418 of 2020 pending in the court of learned Chief Judicial Magistrate, Banka.

Prayer is refused.
