Petitioner apprehends his arrest in connection with Giriyak P.S. Case No. 69 of 2017 registered for the offences punishable under Sections- 30(D)/32 of Bihar Prohibition and Excise Case, 2016.

Learned counsel for the petitioner submits that there is recovery of 590 tins of Kala Gur from the shop of the petitioner. In fact, petitioner deals in the business of Raw Slabat for which no license is required. Petitioners works in the name and style of M/s Raj Trading Company, which is a registered firm vide Annexure-2. Petitioner is genuine purchaser and seller of the Raw Salbat as would be evident from the documents annexed as Annexure- 3 and 4.

No.15904 of 2017 (2) dt.06-06-2017 2/2 Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 6th, Nalanda in connection with Giriyak P.S. Case No. 69 of 2017 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
