JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-03-2017 By an order dated 17.06.2016, the opposite party No. 2 has been allowed anticipatory bail by the court of learned Sessions Judge, Bhojpur at Ara. He is an accused of offence punishable under Sections 420, 465, 466, 471, 467, 341 and 323 of the Indian Penal Code in Jagdishpur P.S. Case No. 99 of 2016. He is said to have induced the petitioner to enter into an agreement for S & F agency of Medicine Company and thereby pay a substantial amount, which he subsequently misappropriated. The present application has been filed seeking cancellation of bail so granted by the court of learned Sessions Judge, Bhojpur at Ara. There is no allegation of misuse of privilege of bail. Discretion exercised by the court below while

Patna High Court Cr.Misc. No.13588 of 2017 (2) dt.22-03-2017 2/2 giving the opposite party No. 2 concession of anticipatory bail, cannot be said to be completely unjustified.

I do not find any reason to entertain this application since no ground for cancellation of bail is made out. This application is, accordingly, dismissed.
