2. The petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 153 of 2023, registered for the offence punishable under Sections 341, 342, 323, 308, 379, 504, 34 of the Indian Penal Code.

3. As per prosecution, petitioner is said to have assaulted the victim with the iron rod.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecednet and he is in custody since 22.04.2023.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.45738 of 2023(2) dt.28-07-2023 2/2 for bail.

6. Considering the aforesaid fact and also considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Sangrampur P.S.
