Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 326, 307, 302 of the Indian Penal Code.
Earlier the bail petition of the petitioner was rejected twice vide orders dated 21.06.2019 and 15.12.2021 passed in Cr. Misc. No. 16012 of 2019 and Cr. Misc. No. 45514 of 2021 respectively.
Vide order dated 09.12.2022, a report was called for with regard to the stage of the trial. Report dated 23.12.2022
Patna High Court CR. MISC. No.45221 of 2022(5) dt.15-03-2023 2/2 reveals that all chargesheeted witnesses have been examined and the case is pending for the defence evidence. In view of the report of the learned trial court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 27 of 2019 arising out of Jankinagar P.S. Case No. 131 of 2018 pending in the Court of learned A.D.J. 8th, Purnea. Prayer is refused.
However, the learned Trial court is directed to expedite the trial and conclude the same expeditiously. (Rajesh Kumar Verma, J) Ibrar//- U T
