JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The application is for grant of anticipatory bail in connection with Mahila (Saran) P.S. Case No. 46 of 2015 registered for offence under section 498A/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that marriage was solemnized about 15 years ago and the petitioner is still ready to keep his wife (opposite party no. 2) with full honour and dignity.
Heard learned A.P.P. also.
Having heard both sides and on perusal of the First Information Report it appears that there is allegation of demand of dowry, torture and assault. The petitioner is the husband of
Patna High Court Cr.Misc. No.9924 of 2017 (2) dt.06-03-2017 2/2 opposite party no. 2.
Considering the aforesaid aspect of the matter, this Court is not inclined to grant bail to the petitioner at this stage. However, he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit, considering as to whether there is any chance of mediation between the parties. If that be so, the court below is directed to release the petitioner on provisional bail and confirm the same after seeing his conduct, otherwise to pass any order, which will be deemed fit and proper.
Accordingly, this petition is disposed of.
