The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

Prosecution case in nutshell is that petitioner along with other co-accused persons, variously armed, assaulted the informant's brother. It is specifically alleged that the petitioner assaulted the informant's friend on his head by means of danda, due to which he

Patna High Court CR. MISC. No.45117 of 2022(3) dt.09-01-2023 2/3 sustained injuries. It is also alleged that petitioner had took away golden chain from the neck of cousin brother of the informant.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case due to land dispute. It is also submitted that petitioner is languishing in judicial custody since 10.05.2022. It is further submitted that injuries sustained by Bhanu Bhushan prasad and Neeraj Yadav are simple in nature and not on the vital part of the body. There is no any eye witness to whisper about the complicity of the petitioner in the alleged offence. It is further submitted that similarly situated co-accused person has been granted anticipatory Bail vide order dated 23.03.2022, passed in Cr. Misc. No. 44460 of 2021 by this Court.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties

Patna High Court CR. MISC. No.45117 of 2022(3) dt.09-01-2023 3/3 and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Gardanibagh P.S. Case No. 60 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIV, Patna.
