Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 34 in connection with Lakhisarai (Kabaiya) P.S. Case No. 15/2018.
Allegation against the petitioner is of assaulting the informant causing injury to him.
Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and the injury is simple in nature.
Heard learned Additional Public Prosecutor as well as learned counsel for the informant. They have opposed the prayer
Patna High Court Cr.Misc. No.28274 of 2018 (3) dt.17-05-2018 2/2 for bail stating that the petitioner has lost his eye sight. Considering the facts aforesaid and that the injury is simple in nature, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No. 15/2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation of the case and he will make himself available before the police as and when required.
