JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2021 Heard Mr. Harendra Prasad, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Basantpur P. S. Case No. 390 of 2020, dated 17.09.2020, instituted for the offences under Sections 272, 273 and 308 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
10 litres of mahua liquor is said to have been recovered from the house of the petitioner.
The learned counsel for the petitioner has submitted that the house is not in exclusive possession
Patna High Court CR. MISC. No.738 of 2021(2) dt.24-06-2021 2/2 of the petitioner but he is just one of the inmates. The petitioner has clean antecedents.
However, these grounds do no weigh with this Court for granting anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail that shall be considered on its own merits, without being prejudiced by the fact that the present petition has not been entertained by this Court.
