JUSTICE RAMESH KUMAR DATTA ORAL JUDGMENT Date: 24-08-2016 Mr. Mrigank Mauli, learned counsel for the petitioner and Mr. Y.V.Giri, learned senior counsel for the respondent-National Institute of Technology (NIT) appearing along with Mr. Sanjay Kumar Giri, Advocate on record for the respondent, upon instruction from their respective clients submit that they are willing to have the matter referred to arbitration.

Patna High Court CWJC No.19030 of 2015 dt.24-08-2016 2/2 They further submit that both the parties are agreed that the arbitration be held by Mr. Justice Jayanandan Singh, a former Judge of this Court. The parties are further agreed that the fee of the Arbitrator shall be in accordance with that prescribed in the 4th Schedule of the Arbitration and Conciliation Act, 1996. In the above circumstances, the matter is referred to arbitration by Mr. Justice Jayanandan Singh in accordance with the terms and provisions of the Arbitration and Conciliation Act, 1996. Let the parties appear before the said learned Arbitrator, on 3rd September, 2016.

The writ application is, accordingly, disposed of with the aforesaid direction.
