JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2021 Heard Mr. Sujit Kumar Singh, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Bithan P. S. Case No.48 of 2020, instituted for the offences under Section 7 of the Essential Commodities Act, 1955.
The petitioner is suspected of selling the controlled grains in black market. According to the accusation, 25 bags, each containing 60 Kgs. of rice was seized from a vehicle. The Block Supply Officer, Rosera suspected that those bags were the property of Food Corporation which was being diverted by the petitioner.
The petitioner is a P.D.S. Dealer. It has been argued that without verifying the stock of the petitioner, the prosecution
Patna High Court CR. MISC. No.40689 of 2020(2) dt.22-06-2021 2/2 against her ought not to have been launched.
For the reasons afore-stated, the petitioner abovenamed, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Rosera, Samastipur in connection with Bithan P. S. Case No.48 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
