====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-05-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 147, 148, 149, 427, 436 and 120B of the Indian Penal Code, Sections 3/4 of the Explosive Substance Act and Sections 10/13 of the U.A.P. Act. Prosecution case is that no one of the Naxal group was identified at the time of occurrence rather subsequently the villagers who were admittedly not present at the time of occurrence informed to the police regarding involvement of the petitioner and others. Though the petitioner has got criminal antecedent, however there is no direct material against the petitioner in this case. Petitioner is in custody since 03.03.2019. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.2001 of 2021(3) dt.21-05-2021 2/2 bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kajra P.S. Case No. 19 of 2014, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
