JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 19-02-2015 The present contempt application is filed for noncompliance of the order dated 23.03.2012 passed in C.W.J.C. No. 5455 of 2012 whereby the direction was given to the respondents to consider the case of the petitioner as one time measure for regularization, or otherwise, in terms of the Constitution Bench Judgment and take a final decision in accordance with law, preferably within two months from the date of receipt/production of a copy of this order.
Learned AC to SC -3 submits that in compliance of the order dated 23.03.2013 passed in C.W.J.C. No. 5455 of 2012, the case of the petitioner was considered by the District Education Board
Patna High Court MJC No.1910 of 2013 dt.19-02-2015 2/2 through speaking order on 10.01.2015 refusing his claim for regularization, which would appear from Annexure-D of the show cause filed on behalf of the opposite party no4. In view of the above submission, since the order under contempt is complied by opposite parties, no further action is required to be taken. Accordingly, this contempt application is disposed of. However, if petitioner feels aggrieved, he may take recourse in accordance with law.
