The petitioner apprehends his arrest in connection with Ghoswari P.S. Case No.39 of 2018 registered under Sections 304(B) and 120(B)/34 of the Indian Penal Code. The accusation is of killing the deceased, the daughter of the informant, by her husband and other in-laws for nonfulfillment of the dowry demand by administering poison. Learned counsel for the petitioner submits that the petitioner is the cousin brother-in-law of the deceased and the petitioner along with his father used to reside to the family of the husband of the deceased but with an ulterior motive, the petitioner along with his father have also been implicated in this

Patna High Court CR. MISC. No.42072 of 2019(3) dt.05-09-2019 2/2 case. Moreover, the husband of the deceased, namely, Shukul Yadav, is already in jail custody. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Barh, Patna, in connection with Ghoswari P.S. Case No.39 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
