2. This is the second attempt of the petitioner for grant of Regular bail as earlier the bail application of the petitioner was rejected vide order dated 07.11.2023 passed in Cr. Misc. No. 71388 of 2023 and the same reads as under:- Heard learned counsel for the petitioner and Mr. Anil Kumar, learned Additional Public Prosecutor for the State.

2. The petitioner is in custody since 25.05.2023 in connection with Turkauliya P.S. Case No. 27/2023 registered for the offence punishable under Sections 392 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is involved in looting Rs. 1.25 Lakhs.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner is not named in the F.I.R., his name surfaced in the confessional statement of the co-accused Guddu Sahani. He next submits that no cogent material has come to show the complicity of this petitioner in the alleged crime.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He submits that the petitioner is having seven more case of similar nature. 6. Considering the facts

Patna High Court CR. MISC. No.47318 of 2024(2) dt.26-07-2024 2/2 and circumstances of the case and also the criminal antecedent of the petitioner, I am not inclined to grant him bail. It is, accordingly, rejected.

6. The trial of all the cases registered against the petitioner are directed to be expedited.

7. Let a copy of the order be communicated to the learned District Judge, East Champaran as well as to Superintendent of Police, Motihari, through FAX/e-mail forthwith for compliance of the order.

3. The petitioner is accused in seven more cases of similar and serious nature.

4. In view of the above, this Court is not inclined to review its earlier order, though, some accused persons have been granted bail by this Court.

5. Accordingly, this application is dismissed.

6. The trial is directed to be expedited.
