2. The petitioner seeks bail in connection with Tekari P.S. Case No. 47 of 2025 instituted for the offences under Sections 127(1), 127(2), 115(2), 85, 87, 61 of the Bhartiya Nyaya Sanhita, 2023 and Section 3⁄4 of the D.P. Act.
3. As per prosecution case, the accusation against the accused persons including the petitioner is of harassing, torturing and, ultimately, committing murder of the informant's daughter for non-fulfillment of dowry demand and concealing the dead body.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged
Patna High Court CR. MISC. No.44217 of 2025(4) dt.15-09-2025 2/3 against him and has falsely been implicated in the present case. The petitioner is the father-in-law of the deceased. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. Learned counsel for the petitioner further submits that the police, on the disclosure made by Shiv Kumar, recovered the dead-body of the deceased in Moharrar river but, strangely, he was not made accused in the present which creates doubt in the veracity of the persecution case. The petitioner has no criminal antecedent and is languishing in judicial custody since 30.01.2025 without any rhymes or reason. Charge-sheet has been submitted in this case.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. The Investigating Officer, after completion of investigation, has submitted charge-sheet finding the case true against the petitioner for offence under Sections 80/238/61(2) of the B.N.S., 2023. He further submits that the prayer for bail of the coaccused Shiv Kumar Prasad has already been rejected by this Court vide order dated 09.09.2025 passed in Cr. Misc. No. 40553 of 2025.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, the petitioner having no criminal antecedent as also there being no direct allegation against the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Tekari P.S.
