The petitioners apprehend their arrest in connection with Complaint Case No. 964 of 2016, registered under Sections 323, 379, 498(A) and 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of torturing of the complainant by her husband and in-laws due to non-fulfillment of dowry and also removing her from matrimonial house.
Learned counsel for the petitioners, in presence of learned counsel appearing on behalf of O.P. No.2, submits that on the
Patna High Court Cr.Misc. No.17457 of 2017 (5) dt.05-12-2017 2/2 joint prayer of the parties the matter was referred to Mediation Centre, Patna High Court, Patna for settlement of the dispute between the parties, but the mediation could not be succeeded. Further submission is that, in fact, Munna Thakur, husband of the complainant did not turn up before the Mediation Centre for mediation and settlement of dispute and he is absconding due to that reasons, mediation could not be succeeded. The petitioners are sister-in-law (Gotani), brother-in-law and father in law of the complainant (O.P. No.2).
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Complaint Case No. C/964 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
