JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 769/17, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner is that an agreement has been reached between the complainant and the petitioner and petitioner agreed to sale his 1 katha 4 dhurs of land to the complainant for a consideration of Rs. 5,50,000/- per katha and it is alleged that the petitioner is neither executing the sale deed nor returning the money.

It has been submitted on behalf of the petitioner that he is still ready to execute the sale deed in favour of the complainant if he is ready to pay the agreed amount.

Patna High Court Cr.Misc. No.24482 of 2018 (3) dt.18-07-2018 2/2 Heard learned A.P.P. also.

None has appeared on behalf of the complainant in spite of notice validly served upon him.

Having heard both sides, in view of the above facts, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Patna City, in connection with Complaint Case No. 769/17, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. it is further subject to the condition that:- One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
