JUSTICE VIKASH JAIN ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned APP for the State through video conference. Learned counsel for the petitioner has filed an undertaking to remove all the defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.

2. Learned counsel for the petitioner states that by order dated 01.07.2020 passed in Cr. Misc. No. 84974 of 2019, time for surrender and furnishing bail bond was extended by four weeks in connection with anticipatory bail granted in Cr. Misc. No. 38128 of 2019. It is stated however, that time to furnish bail bond online on 14.07.2020 did not succeed. As such, the present modification petition for further extension of

Patna High Court CR. MISC. No.9421 of 2021(2) dt.07-04-2021 2/2 time was filed on 01.02.2021.

3. Except a vague averment to the effect that attempt to furnish bail bond online on 14.07.2020 did not succeed, no details in this regard have been offered, nor why effort was not sustained by making further attempt to surrender before the Court and furnish bail bond despite sufficient time remaining. Besides, there is considerable delay and laches on the part of the petitioner in approaching this Court with the present petition.

4. Accordingly, this Court is not inclined to accede to the prayer of the petitioner. The petition stands dismissed.

5. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
