JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-08-2017 The petitioner seeks a direction commanding the Chairman, Bihar State Madarsa Education Board, Patna(hereinafter referred to as the Board) to grant permanent approval of the Managing Committee of Madarsa Islamia Nooria, Pachchali Madhepur, in the district of Madhubani, to be headed by Mr. Shakeal Ahmad as President and the petitioner Md. Matiur Rahman as Secretary in continuation of memo No. 8118-26, dated 19.12.2012.
2. A counter affidavit has been filed on behalf of the Board, Patna, in which it has been stated that local residents, in a general meeting have resolved to dissolve the said Committee and
Patna High Court CWJC No.15999 of 2016 (3) dt.22-08-2017 2/2 they have constituted a new Committee of the Madrasa in question. It has also been stated that the Board has entrusted the enquiry to the District Education Officer, Madhbani. It has also been stated that the grant of approval of the Committee shall be considered after taking into account the report of the District Education Officer, Madubani.
3. On perusal of the counter affidavit, I find that it is now the Board, which has to take decision after receiving report from the District Education Officer, Madhubani. It has been stated at the bar that the report of the District Education Officer, Madhubani has been received by the Board.
4. Let the Board take a decision on the question of the genuineness of the Managing Committee of the Madrasa in question on the basis of a report of the District Education Officer, Madhubani expeditiously, preferably within a period of two months from today.
