The petitioner apprehends his arrest in connection with Asarganj P.S. Case No.96 of 2018 registered under Sections 376, 323 and 511 of the Indian Penal Code, pending in the court of the Additional Chief Judicial Magistrate-II, Munger. The accusation is of entering of the petitioner at the house of the informant in the night of 27/28.08.2011 and committing rape on the informant on the point of pistol. Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of

Patna High Court CR. MISC. No.44125 of 2019(2) dt.18-07-2019 2/2 anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
