Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code, u/s 27 of Arms Act and u/s 3⁄4 of Explosive Substance Act.

As per the prosecution case, while the informant and his friend were sitting at his office, as a result of indiscriminate firing by four unknown accused persons, the son of informant was injured and died in course of treatment.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner

Patna High Court CR. MISC. No.55008 of 2021(2) dt.29-01-2022 2/2 has come in this case during the course of investigation in the confessional statement of co-accused, Ravi Shrivastava. Only material that has come against this petitioner that he along with other accused persons in conspiracy got killed the son of informant. Similarly situated accused Gufran @ Gufran Alam has already been granted bail by a co-ordinate Bench of this court vide order dated 12.01.2022 passed in Cr. Misc. No. 31067/2021. Petitioner claims clean antecedent and is in custody since 18.04.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mirganj PS case No. 08/2021.
