The petitioner apprehends his arrest in Dulhinbazar P.S. Case No. 04 of 2017, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. The informant alleged that in the mid of the night the petitioner scaled over her roof and tried to opened the door of her house in order to commit rape, but on alarm the petitioner fled away after taking Rs. 10,000/- from the house of the informant. Learned counsel for the petitioner submits that the petitioner is nephew of the informant. Son of the informant runs a PDS shop. Some dispute arose, therefore, the informant filed this false case, but from perusal of the case diary it appears that the informant and other witnesses have also supported the version of

Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
