The petitioner apprehends his arrest in connection with Warish Nagar (Mathurapur O.P.) P.S. Case No. 287 of 2016, registered under Section 7 of the Essential Commodities Act. The accusation is that on the raid of the Godown of Jeebach Mahto, father of the petitioner, several packets of wheat and rice were found, on which, FCI and SFC logo were printed, which was being recycled for black marketing. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion as petitioner is the P.D.S. dealer. In fact, petitioner is the
Patna High Court Cr.Misc. No.19188 of 2017 (4) dt.25-07-2017 son of Jeebach Mahto, whose godown was seized due to that reason petitioner being the P.D.S. dealer has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Samastipur, in connection with Warish Nagar (Mathurapur O.P.) P.S. Case No. 287 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
