Heard learned counsel for the petitioner.

The petitioner apprehends his arrest in connection with Kuchaikote P.S. Case No. 273 of 2020, registered for the offences punishable under Sections 341, 420, 406, 504, 506/34 of the Indian Penal Code.

Vide order dated 09.12.2021 the matter was referred to the District Mediation Centre, Gopalganj for exploring the possibility of amicable settlement of the matter.

The report of District Mediation Centre, Gopalganj dated 05.01.2022 has been received and annexed with the record as flag

On perusal of the report of Mediator it appears that both the parties have compromised the case and as per terms and conditions of the compromise, the petitioner has to pay Rs. 1,50,000/- to the informant to which Rs. 30,000/- was paid in the Mediation Centre on 05.01.2022. It was agreed upon that the rest amount of Rs. 1,20,000/- will be paid in six equal monthly installments and the first installment will be paid on 15.02.2022. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.

Gopalganj in connection with Kuchaikote P.S. Case No. 273 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. If the above-mentioned amount is not paid within the stipulated period, the court below shall be at liberty to cancel the bail bond.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
