JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-08-2024 The present writ petition has been filed seeking the following relief:- "1. That this writ petition is being filed for issuance of an appropriate writ / writs, order / orders, direction / directions for payment of financial incentives under Bihar Rajya Fasal Yojana Khareeph-2022 to the farmers of Gram Panchayat, Baijalpur and Paragarhi of Sabour Block, within the District of Bhagalpur whereby and whereunder in spite of list of beneficiary submitted by Block Development

Patna High Court CWJC No.10172 of 2024(2) dt.06-08-2024 2/3 Officer, Sabour the financial incentives to the farmers of Gram Panchayat, Baijalpur and Parogarhi have not been paid as yet due to the arbitrary attitude of respondents and for other necessary relief/reliefs on the basis of the facts and circumstances of the case."

At the outset, the learned counsel for the respondent-State has submitted, by referring to paragraphs no. 8 to 10 of the counter affidavit filed in the present case on behalf of the respondents no. 3 to 6, that the Block Development Officer, Sobour has already sent the list of beneficiaries vide letter dated 27.02.2024 to the District Cooperative Officer, Bhagalpur, whereafter the same has been sent to the Joint Registrar (Headquarter), Cooperative Societies, Patna vide letter dated 18.04.2024 for needful action.

In view of the aforesaid, the learned counsel for the petitioner submits that the respondent no. 2 i.e. the Registrar, Cooperative Societies, New Secretariat, Patna be directed to verify the actual facts and upload the list on the online portal for the purposes of grant of benefits

Patna High Court CWJC No.10172 of 2024(2) dt.06-08-2024 3/3 to the farmers under the Bihar Rajya Fasal Yojana Khareeph-2022, forthwith, so that the Block Development Officer, Sobour can disburse the financial incentives to the eligible farmers. It is directed accordingly.
