JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 419, 420, 467, 468, 471 of the Indian Penal Code and u/s 66 of the I.T. Act. As per the prosecution case, on 07.05.2021 at about 12.15 PM the informant got information that six persons have been assembled to commit some fraud, a raid was conducted and four persons were apprehended who disclosed the name of petitioner and other accused persons as the person who fled away from the place of occurrence.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that save and except disclosure made by

Patna High Court CR. MISC. No.54941 of 2021(4) dt.06-07-2022 2/2 other co-accused, there is no tangible materiel to collect the petitioner in the aforesaid crime. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Giriyak (Katrisarai) PS case No.188/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
