JUSTICE SHIVAJI PANDEY ORAL ORDER 07-12-2015 Heard counsel for the appellant and the respondents. In the present case, petitioner is seeking initiation of contempt proceeding against the Opposite Parties for violation of order dated 4th November 2010 passed in CWJC No. 6968 of 1991.
This Court, while disposing of the matter has dismissed the writ application with liberty to the petitioner to t ake
Patna High Court MJC No.3856 of 2012 (8) dt.07-12-2015 2/2 whatever legal remedy available to the petitioner. In pursuance of the direction, other side has fled Title Suit No. 227 of 2010 which is pending for adjudication. In view of pendency of suit, application filed by the petitioner for seeking registration of the sale-deed in his favour has not been entertained. The petitioner had not filed writ petition rather other side had filed the writ petition which was dismissed, with certain liberty to the petitioner.
This Court does not find any ground to initiate the contempt proceeding. Accordingly, this petition is dismissed. Petitioner, if so advised, may exhaust the remedy available to him under law.
