There was a total outstanding dues of Rs. 2,38,35,314/- and the petitioner, in one go, has deposited Rs. 1,25,00,000/-. As on today, after granting exemption, the petitioner has to pay Rs. 1,15,00,000/-. The petitioner is agreeable to settle the dispute on payment of Rs. 1,10,00,000/- but, the Bank says that maximum exemption has already been extended, no further benefit can be extended. Thus, there is only a gap of Rs. 5,00,000/-.

Patna High Court CWJC No.18203 of 2016 dt.17-04-2017 Learned counsel for the Bank submits that the total outstanding due against the petitioner is 1,27,38,382/- and the Bank is agree to settle the dispute at Rs. 1,15,95,519/-. A claim has been made by the petitioner that he will deposit Rs. 35,00,000/- by 30.6.2017 but, with no interest and rest of the amount will be paid in equal installments within six moths including interest at the rate of 9.35%.

The Bank will consider the request of the petitioner of settling the dispute in Rs. 1,10,00,000/- as well as the Bank will be also obliged to consider the request of the petitioner about granting exemption of payment of interest up to three months and, for the rest period, the petitioner will pay the amount along with 9.35% interest. With the aforementioned observation, this application is disposed of.
