Petitioners apprehend their arrest in connection with Bahera P.S.Case No. 356 of 2017 registered for the offences punishable under Sections 447, 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioners Nos. 1 and 2 is of assault by 'tangi' and causing injuries to the informant and his father and there is no specific allegation against petitioner No.3. Submission of learned counsel for the petitioners is that both the informant and petitioners are brothers and there is land dispute between the parties and injuries are simple in nature except one injury on elbow which is not vital part of the body.

Patna High Court Cr.Misc. No.13210 of 2018 (3) dt.24-04-2018 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail. Having heard both sides and in the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur, District Darbhanga, in connection with Bahera P.S.Case No. 356 of 2017, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
