JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2021 Heard learned counsel for the petitioners and the State. Petitioners seek regular bail in a case registered for the offence punishable under section 323 and other ancillary sections of the Indian Penal Code.
As per the prosecution case, on the instigation of petitioners, other accused persons are alleged to have set the house of the informant on fire and pushed the informant, goat and three kids in the fire.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to land dispute. Marpit also took place between the parties. Petitioners have been alleged to be instigators.
Patna High Court CR. MISC. No.54080 of 2021(2) dt.03-12-2021 2/2 Petitioners claim clean antecedent and they are in custody since 28.5.2021. Investigation is complete.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let all the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in Singhwara Police Station Case No. 66 of 2021.
