JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with CII Case No. 146 of 2010, disclosing offences under Sections 5, 8 and 14 of the Bihar Saw Mills (Regulation) Act, 1990 and Sections 41 & 42 of the Indian Forest Act, 1927 (Bihar Amendment Act, 1989).
As per F.I.R. petitioner was running saw mill without having proper license. Case is of the year 2012. Submission of the learned counsel for the petitioner is that as a matter of fact, the saw mill was running by one Pankaj Kumar Sharma and the petitioner has falsely been implicated in this case. Further submission is that though the order is of year 2012, but the entire order sheet has been brought on record to show only bailable warrants were issued against him. As such, he has no knowledge about the same. He is ready to abide by

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Purena, in connection with CII Case No. 146 of 2010, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
