The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 342, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
It is a case of assault upon the informant by the accused persons including the petitioners.
It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that from perusal of the injury report which annexed with this petition, it appears that three injuries
Patna High Court CR. MISC. No.56966 of 2021(2) dt.06-07-2022 2/2 sustained by the informant, out of which injury no.3 is grievous as opined by the doctor and other are simple in nature. He further submits that there is case and counter case between the parties and both parties have sustained injuries as alleged in separate incident. Petitioners have got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, West, Muzaffarpur in connection with Kurhani P.S. Case No. 180 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
