The petitioner is apprehending his arrest in connection with N.D.P.S.Case No.12 of 2017 arising out of Barauni Zeromile P.s.Case No.186 of 2017 registered for offences punishable under Sections 20/22 of the NDPS Act.

Allegation against the petitioner is that from the Truck 583 KG of Ganja was recovered and the petitioner is the owner of the vehicle.

Submission of the learned counsel for the petitioner is that he is only owner and as a matter of fact the Driver and the Khalashi were present there and they have also not stated that all the contrabands belong to the petitioner.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.25170 of 2018 (3) dt.29-06-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
