JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2018 Heard learned counsel for the petitioners.
Petitioners apprehend their arrest in connection with Kudra P.S.Case No. 07 of 2018 registered for the offences punishable under Sections 365 and 120B of the Indian Penal Code. Allegation against the petitioners is of abducting the father of the informant.
Submission of learned counsel for the petitioners is that except petitioners have purchased the land from the father of informant there is no other circumstance against them and they have been made accused only on the basis of suspicion. Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail of the petitioners.
Having heard both sides and in the facts and circumstances, let the petitioners surrender in the court below
Patna High Court Cr.Misc. No.14471 of 2018 (3) dt.24-04-2018 2/2 within a period of four weeks from the receipt of this order and on their so surrendering they shall be released on provisional bail till the submission of charge sheet on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Kaimur, Bhabua, in connection with Kudra P.S.Case No. 07 of 2018 on the condition that petitioners shall have to co-operate in investigation and appear before the police as and when required, otherwise their bail bonds shall be cancelled. It is made clear that once charge sheet has been submitted against the petitioners, in that event, they shall have to surrender in the court below and make prayer for regular bail, which shall be considered on the basis of materials available on record at that time.
With the above observation, this application is disposed of.
