Ms. Anita Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-05-2021 Heard the parties in virtual Court proceeding. The petitioners are languishing in custody for the offences punishable under Sections 30(a)/33/36 of the Bihar Prohibition and Excise Act, 2018.

Liquor was recovered from a Bolero vehicle. Petitioner Shashi Kant Rai is owner of that vehicle. Some more liquor was recovered from the house of co-accused Ajit Patel. Petitioner No.2 Amrit Kumar Singh was there in the house of Ajit Patel at the time of recovery of liquor. The petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 04.09.2020. Investigation of the case is already complete.

No.3242 of 2021(3) dt.24-05-2021 2/2 Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dinara P.S. Case No.265 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
