JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-06-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Chand P.S. Case No. 41 of 2020, registered under Sections 341, 323, 337, 338, 307 and 504/34 of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel appearing for the petitioner submits that, earlier, the bail prayer of the petitioner was refused on merit on 10.07.2020 vide Criminal Miscellaneous No. 21557 of 2020 taking into consideration the nature of allegation against the petitioner to cause fracture of lateral margin of humerus caused by hard and blunt substance of the son of the informant. Further submission is that the petitioner

Patna High Court CR. MISC. No.2726 of 2021(3) dt.23-06-2021 2/2 is in custody since 07.04.2020 about more than one year. The petitioner has no criminal antecedent.

Having regard to the facts and the circumstances of the case and the period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-IV, Kaimur at Bhabua in connection with Chand P.S. Case No. 41 of 2020.
