JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-05-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Roh P.S. Case No. 12 of 2016 for the offences punishable under sections 467, 468, 420, 379, 323 and 504/34 of the I.P.C.
Allegedly, the informant purchased land of Khana No. 58, Plot No. 1433, area 8-1⁄2 decimals from Sahjanand Singh and Ramotar Singh on 16.02.2000 and since then the informant is in possession. His name has already been mutated in the Anchal Office and paying the rent. On 15.08.2015 when the informant was ploughing his land then the petitioners came being armed, forbade the informant to plough the land. Accused Babulal Singh
Patna High Court Cr.Misc. No.13659 of 2017 (2) dt.05-05-2017 2/2 told the informant that this plot has been purchased by father of the informant, then the informant replied that his father has got no right to sale the land and then Babulal Singh pointed out pistol and snatched Rs. 2,000/- from the pocket of the informant and also caused threats.
Submission is of false implication and that the petitioner no.1 is own brother of the informant, petitioner nos.2 and 4 are nephews of the informant and petitioner no.3 is the wife of petitioner no.1, the dispute appears purely of family dispute and of civil nature and as such the petitioners deserve sympathetic consideration.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.
In the facts and circumstances as stated above, considering the nature of the dispute, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Nawada in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
