The petitioner seeks bail in a case registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Allegation against the petitioner alongwith other accused persons is said to have killed the victim due to nonfulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner is in jail custody since 19.07.2019 and has got no criminal antecedent.

Learned APP for the State opposes the prayer for bail petition of the petitioner and submits that the petitioner is

Patna High Court CR. MISC. No.39777 of 2020(3) dt.10-03-2021 2/2 husband of the deceased.

Considering the aforesaid facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Nautan P.S. Case No. 258/2019 from the Court of learned Chief Judicial Magistrate, Bettiah, West Champaran. Accordingly, this application is dismissed.
