No.52658 of 2016 Learned counsel for the petitioner submits that the petitioner was allowed anticipatory bail on 19.12.2016 vide Cr.Misc. No.52658/16 with direction that the petitioner was ordered to be released on bail in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the J.M.,1st Class, Madhubani, in Basopatti P.S. Case No.28 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. But due to illness of the petitioner, he could not surrender within the stipulated period and pray for extension of four weeks' further time to surrender before

Patna High Court Cr.Misc. No.11542 of 2017 (2) dt.08-03-2017 2/2 the court below.

In view of the aforesaid submission, four weeks' further time from today is allowed to the petitioner to surrender before the court below in Basopatti P.S. Case No.28/16 and, accordingly, order dated 19.12.2016 passed in Cr.Misc. No.52658/16 is modified to the extent stated above. The modification application is, accordingly, allowed.
