JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2018 The petitioner is apprehending his arrest in connection with Majorganj P.S. Case No. 203/16, registered for offences punishable under Sections 385 and 387 of the Indian Penal Code. Allegation against the petitioner is of threatening and demanding Rs. 10 lakh as ransom.
It has been submitted on behalf of the petitioner that he is not named in the FIR, his name surfaced in this case only on the basis of confession of co-accused and except that there is nothing against the petitioner and the mobile from which, the ransom was demanded also does not belong to the petitioner. So far criminal antecedents are concerned, he is on bail in all those cases. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.14621 of 2018 (3) dt.24-04-2018 2/2 circumstances of the case as well as the fact that petitioner is an accused of five other cases of serious nature, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.
The petitioner if so desire may surrender and pray for regular bail, which will be considered by the court below on the merit of the case.
