JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 26-10-2016 After having heard the parties and taking into consideration the averments made in the show cause filed on behalf of the opposite party no.2, this Court is satisfied that the order of the Writ Court dated 10.12.2014 passed in C.W.J.C. No. 6670 of 2014 has been complied with and no case for initiation of contempt proceeding is made out.
In above view of the matter, the present M.J.C. application is dismissed. However, the petitioner, if so advised, shall be at liberty to challenge the final order dated 5.5.2015 passed by the District Collector, Katihar, as contained in Annexure-B to the show cause filed on his behalf, in an appropriate proceeding before the appropriate forum/ court.
