Petitioner claims to have retired from service on 31.07.2013 from the post of Accountant from the L. N. College, Bhagawanpur, a constituent unit of B. R. A. Bihar University, Muzaffarpur. It is contended that petitioner has not been paid post-retiral dues, such as, gratuity, Earned Leave, Group Insurance as well as arrears of differences of salary after merger of scale as well as arrear of differences of salary after grant of ACP and also the arrear of pension from 01.08.2013 to February 2015. It is further contended that pension was being paid from March 2015 but the same has again been discontinued since February 2016.
Patna High Court CWJC No.982 of 2016 dt.19-05-2016 2 / 2 No counter affidavit has been filed in this case. In above view of the matter, this writ application is being disposed of with a direction to the respondent no.2, the Registrar, Bhim Rao Ambedkar Bihar University, Muzaffarpur to calculate the admissible amount of post retiral dues of the petitioner and ensure payment of the same within a period of three months from the date of receipt/production of a copy of this order. So far discontinuation of pension and arrears of pension are concerned, a decision has to be taken in accordance with law for payment of that also if the same is found admissible within the aforesaid period. Since it is claimed that the pension was being paid to the petitioner but the same has been discontinued since February 2016, let the respondent no.2 take steps in this regard also so that pension is paid regularly to the petitioner in future.
