Petitioner apprehends his arrest in connection with Nabinagar P.S. Case No. 139 of 2012, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 427, 504, 337, 120B of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner and other accused persons is that they have tried to dispossess the contractor of Nabinagar Thermal Plant and also he was assaulted them. Submission of learned counsel for the petitioner is that he is a displaced person from the place and he along with other displaced persons has raised voice against acquisition and no specific allegation is attributed against him and the matter has also been compromised.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 139 of 2012, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned.
