JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-02-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of a writ in the nature of mandamus commanding and directing upon the Respondents concerned to consider the claim of petitioners and issue appointment letters to the petitioners against the existing vacancies advertised in Adv. No. 2/2019 for appointment on the post of constables under different organization under Respondent State as

Patna High Court CWJC No.16456 of 2021(2) dt.07-02-2024 2/3 petitioners have qualified all the required test including written test, physical eligibility test and thereafter issued Gate Pass for verification of academic and other claimed documents and despite that till date appointment letters have not been issued and on seeking information only being said that claim is pending with Department.

(ii). For a further direction upon the Respondents concerned to disclose the rest of vacancies against which appointment letters have not been issued also as what is merit position of petitioners and to what merit points till date appointment letters have been issued as both the petitioners have also been declared successful in all the required tests and documents verification has also been done.

(iii). For a direction upon the Respondents concerned to consider the claim of petitioners giving 338 reservation to Women granted by Respondent state in their respective category of candidates as also petitioners belong to EWS (Economically Weaker Section) Category and submitted necessary certificate in this regard." 2.

At the outset, the learned counsel appearing for the Respondent-Central Selection Board of Constable has referred to paragraph no. 13 of the counter affidavit, filed in the present case, to submit that though the cut off marks for the category of

Patna High Court CWJC No.16456 of 2021(2) dt.07-02-2024 3/3 the petitioners is 64, however, the petitioners have obtained only 60 marks, hence, they have not qualified in the selection process.

In view of the aforesaid, the learned counsel for the petitioners submits that if that be the matter, the present writ petition be disposed off.
