Petitioners apprehend their arrest in connection with a case registered under Sections 302 and 34 of the Indian Penal Code.
Allegation in brief is that these two petitioners had assaulted the informant's father due to land dispute and he succumbed to injury.
It is submitted that due to land dispute, petitioners have falsely been implicated in this case whereas the fact is that he fell down from staircase and died.
Having considered the said fact that there is specific allegation of assault against these two petitioners causing death, so
Patna High Court Cr.Misc. No.5761 of 2017 (2) dt.07-02-2017 2/2 the prayer for anticipatory bail of these two petitioners, namely, Pradip Mandal and Dipak Mandal is rejected in connection with Bhawanipur P.S. Case No.199 of 2016 pending in the court of Sub-Divisional Judicial Magistrate, Purnea, District- Purnea. (Arun Kumar, J) N.H./- U T
