The petitioner apprehends his arrest in connection with Complaint Case No.1596 of 2015 registered under Sections 341, 323, 354, 435 and 379/34 of the Indian Penal Code. The accusation is that in the mid night of 30.06.2015/01.07.2015, the complainant/opposite party no.2 Khusboo Kumari, aged about 15 years, daughter of Kusai Das, came out of the house to urinate. At that time, Ranjan Kumar Das (petitioner) and Md. Abdul got down from the Scorpio vehicle and pointing the pistol upon the opposite party no.2, gave threatening of dire consequence. Thereafter, both put the opposite party no.2 on the vehicle forcibly in which two unknown persons were already sitting.

Abdul, the driver of the Scorpio vehicle, attempted to outrage the modesty of the opposite party no.2. In the meantime, the petitioner received the call on mobile and, thereafter, the petitioner and Md. Abdul, took the ornaments of the opposite party no.2 and set freed to her.

Learned counsel for the petitioner submits that the petitioner is the co-village of the opposite party no.2 and due to land dispute in between the father of the petitioner and the father of the opposite party no.2, the father of the opposite party no.2 got managed to lodge the present complaint case with false allegation only to put undue pressure.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIV, Bhagalpur, in connection with Complaint Case No.1596 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
